A 2009 DWI case continues without resolution at least a little longer after District 25 Attorney James C. Gaither announced this week that he will recuse himself from the case.
More than three years ago, Brett Raymond von Drehle was charged with driving while intoxicated, reckless driving and two felony counts of serious injury by vehicle following a May 15, 2009 crash that sent his 2009 Jaguar into the roof of a Hickory house.
Since von Drehle was indicted on felony charges in 2009, his case has been on the court calendar 13 times, including an appearance July 30 when the case was continued again, according to his defense attorney Lisa Dubs.
"I have raised the issue with the district attorney whether or not his office would be the appropriate one to deal with the case," said Dubs, who was retained by von Drehle and made her representation known to the court in January this year. "Without casting stones even (The Observer News Enterprise) articles have made allegations during (Gaither's re-election campaign), specifically about Mr. von Drehle's case."
