Brothers kidnap, beat, rob man

Two Hickory brothers are in custody after kidnapping, robbing and beating an employee of McGuire’s Pub in Hickory early Thursday morning.

Hickory Police officials say Martin Cuellar Cervantez, 48, of Hickory, was driving home from his shift as a cook at McGuire’s about 2 a.m. Thursday when he was stopped by two men at the intersection of 2nd Avenue Northeast and North Center Street near downtown.

The men, brothers Justin and Scottie Maltba, asked Cervantez for a ride, which he declined. However, the brothers forced their way into his vehicle and made him drive to a particular address nearby, said Hickory Police Department Chief’s Assistant Libby Grigg.

Once at the address, the men started beating Cervantez and punching him several times in the face. They took his wallet and his phone. The brothers then put Cervantez in the back half of his own dual-cab pickup truck and started driving through town.

Grigg said the men may have been heading to an ATM to make Cervantez withdraw money. As the men drove recklessly through town, a police officer stopped the truck at the intersection of 5th Avenue Southeast and North Center Street Southeast on suspicion of a DWI.

The officer recognized the Maltba brothers’ name from a call earlier the same night, and when the officer started talking with them, Cervantez motioned that he was distressed, Grigg said.

The officer questioned all three men, and both Maltba brothers were subsequently arrested.

Justin Edward Maltba, 24, and Scottie Bryan Maltba, 19, both of 503 5th St. SW in Hickory, were both charged with kidnapping and common law robbery.

Justin was also charged with possession of marijuana and is in jail on a combined $101,000 secured bond. Scottie is in jail on a $100,000 secured bond.

They are both scheduled to appear in court Feb. 15, according to court records.
